Bradley J. Stoll joined The Wolk Law Firm as an Associate in 2003. Earning his J.D. from Temple University’s Beasley School of Law in 2002, receiving a B.A. (1997) from the University of Maryland. Brad has given appellate arguments before the Pennsylvania Supreme Court and the Ninth Circuit Court of Appeals in cases concerning the application of the General Aviation Revitalization Act.
He successfully defeated summary judgment in the published case of Robinson v. Hartzell Propeller Company before the United States District Court for the Eastern District of Pennsylvania.
On appeal, Brad successfully convinced the Third Circuit Court of Appeals to quash Hartzell’s interlocutory appeal and issue an opinion rejecting the defendant’s argument that GARA created a statutory right to avoid trial [read news release]. This precedent vindicates the rights of accident victims against general aviation manufacturers who misrepresent, conceal, and withhold information from the Federal Aviation Administration.

Brad has successfully argued for the remand of product liability cases involving general aviation aircraft from federal court to the state court. In the face of the aviation defense bar’s attempt to remove all aviation cases filed in state courts to the federal court, where they believe they would receive favorable treatment. Brad successful argued before the United States District Court for the Eastern District of Pennsylvania that general aviation cases should remain in state court despite the defense argument that principles of preemption compelled federal jurisdiction. This marks an important step within the Third Circuit.
Brad’s caseload is not limited to aviation accidents. He has litigated commercial aviation cases involving fraudulent pre-purchase inspections and an oil company’s failure to provide a properly functioning fuel farm able to deliver uncontaminated jet fuel.
